Terms and Conditions of Service

These Terms apply to anyone who uses the Website to publish and/or view Ads, hereinafter referred to as “Users”, and/or to interact with other Users.

Access to the Website and use of its services are reserved exclusively for users who are at least 18 years old.

When publishing an Advertisement and, in any case, whenever using the Website, the User:

warrants that all data, content, information, images and/or texts entered on the Website, hereinafter collectively referred to as the “Content”, are accurate, complete, lawful and truthful, and accepts full responsibility for them under applicable UK law and any other applicable legislation;

in particular, the User declares and warrants, under their own responsibility, that they are at least 18 years old and legally entitled to use the Website and publish Content on it;

the User also undertakes to keep such Content up to date and to amend it whenever any changes occur.

The User further warrants that the images contained in the advertisements they create depict only adults who have given their consent to the publication of their image.

mistress4you.com does not knowingly publish or accept the publication of advertisements containing images of minors, content involving minors, or any content that is illegal under applicable UK law, including laws relating to child protection, illegal sexual content, obscene publications and online safety.

If a User uploads or submits unlawful content, including content involving minors or persons who have not consented to publication, that User assumes full civil and criminal responsibility for such conduct.

Without assuming any general obligation to monitor all Content in advance, if mistress4you.com becomes aware that a User is under 18 years of age, or that an Advertisement concerns or depicts a person under 18 years of age, for example following a report, or if mistress4you.com becomes aware that the Content of an Advertisement is false, unlawful, misleading or partially inaccurate, mistress4you.com may, at its sole discretion and without prior notice, remove the Advertisement and/or any other Content attributable to the User who published it, including the User’s Account.

The Website may contain adult-oriented, erotic or explicit content. In order to protect minors from accessing such material, users are advised to use parental-control and filtering tools, where appropriate.

If you are over 18 years old but believe that adult content may offend you, disturb you, or conflict with your beliefs, values, religion or personal convictions, you must not access the Website and must not use its services.

The digital content, blog articles and information available on the Website, including, by way of example, messages, data, information, text, music, audio, photos, graphics, videos, maps, icons, software, code or other materials, as well as the servers on which such content is hosted, are the property of mistress4you.com.

The User agrees not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell or resell any information, software, products or services obtained from or through the Website.

The User also agrees:

1) not to use the Website or its content for commercial purposes, except where expressly permitted by mistress4you.com;

2) not to access, monitor, copy or extract any content or information from the Website by using robots, spiders, scrapers, crawlers or any other automated means, or by using manual processes for any purpose, without the prior written consent of mistress4you.com;

3) not to cause, or attempt to cause, an excessive or unreasonable load on the Website infrastructure;

4) not to carry out unauthorised deep linking;

5) not to incorporate, frame, embed or reproduce any part of the Website on other websites or platforms without authorisation;

6) not to attempt to manipulate, reverse engineer, decompile, disassemble or otherwise interfere with the software, management system, code or technical infrastructure on which mistress4you.com is based.

By registering on the Website, you accept these clauses and also the implied obligation not to undertake any activity that may harm the Website, its owner, its services or other Users.

You also agree not to publish or distribute any content without the express consent of the relevant rights holder.

In light of these obligations, you expressly agree to indemnify and hold harmless mistress4you.com and the owner of the Website from and against any liability, claim, damage, loss, cost or expense arising from your use of the Website in breach of these Terms of Use or applicable law.

You further declare that you are at least 18 years old, legally of age, and therefore legally capable of using this Website and the services offered in full compliance with these Terms of Use.

mistress4you.com assumes no responsibility for the accuracy, truthfulness or completeness of the information entered by advertisers in their advertisements or by reviewers in their reviews, nor may mistress4you.com in any way be associated with third-party services, third-party websites or their content.

Each profile must be used by one user only, namely the user for whom age verification has been confirmed. The use of an existing profile by any user other than the verified user, or the owner of the telephone number shown in the advertisement, is not permitted.

Each advertiser may have only one online profile at a time for each individual category. A new profile may be created only under specific circumstances and subject to confirmation by the staff.

Early unilateral termination of the website service agreement between the parties, resulting in the removal of the advertisement and the deactivation of the services before the natural expiry date of the advertisement, is always free of charge and may take place at any time, with no penalty for the unused remaining period.

*CLAUSE

In cases where the advertiser has benefited from special promotions provided entirely free of charge at ZERO cost, early termination of the advertisement publication agreement shall require reimbursement of the ancillary costs incurred by mistress4you.com on your behalf for maintaining the web space and management system up to the date of termination, therefore only for the period already used, as follows:

Cancellation within the first 2 weeks from the start of the free promotion: £25 if the cancellation takes place within the first two weeks.

Cancellation after the first 2 weeks from the start of the free promotion: £10 per week from the start date of the free promotion until the termination date.

The reimbursement of the costs listed above applies to each individual advertisement removed before its natural expiry date where that advertisement benefited from a completely free promotion.

Early removal of advertisements that benefited from special promotions will take place after the advertiser has paid the applicable reimbursement.

Paid advertisements, on the other hand, may be cancelled without any ancillary costs.

mistress4you.com is an advertisement browsing service provided to the User “as is”, without any express or implied warranty and without any guaranteed assistance or technical support.

mistress4you.com cannot guarantee with certainty the truthfulness of the advertisements, as it has no direct control over the advertiser who enters the data. Therefore, mistress4you.com is not responsible for the content entered by its Users through the interactive areas of the Website.

Advertisers who, when creating an advertisement, upload a selfie in the appropriate field holding a sheet showing their telephone number may receive the purple “verified advertisement” badge. This badge indicates that behind that telephone number there is the person shown in the photos, or in any case a person who strongly resembles the person shown.

Each User is exclusively and personally responsible for the content they publish on the Website. mistress4you.com will, in accordance with applicable legal provisions, remove and/or block any unlawful content as soon as it becomes aware of it and will cooperate, where required, with the competent authorities.

Advertiser Users are informed that, when they include an email address and/or telephone number in advertisements published on the Website, mistress4you.com has no control over any material that may be sent directly to that email address or telephone number by other Users or by third parties.

The Website may also contain links to third-party websites. Since these websites are not owned by mistress4you.com, they are not under its control and mistress4you.com therefore assumes no responsibility for their content.

The User may not hold mistress4you.com liable, under any circumstances, for any malfunction of the Website and/or for the failure to provide the related services, even where such malfunction may cause errors and/or delays in relation to Advertisements and/or Content.

All advertiser Users who have a registered account on the Website undertake, if they cancel or terminate their telephone contract, to notify mistress4you.com by email at info@mistress4you.com that the telephone number previously used by them is no longer their property. This is intended to avoid unpleasant misunderstandings with the new holders of the telephone number, who might otherwise find an advertisement on our Website without being aware of it.

Indemnity

Each User shall indemnify and hold harmless mistress4you.com, its owner, directors, employees and/or collaborators, in any capacity, from and against any claim for damages, compensation and/or any other liability, including reasonable legal defence costs, brought by other Users and/or third parties in connection with the use of the Website, the related services and/or the Content published and/or viewed.

Each User acknowledges that they receive an independent and adequate benefit and added value from using the Website and/or the related services, also in consideration of the costs incurred by mistress4you.com for their creation, maintenance and management. Therefore, the User declares and guarantees to mistress4you.com their acceptance of these indemnity obligations.

Miscellaneous

The possible invalidity or ineffectiveness of any provision of these Terms shall not affect the validity of the remaining provisions, which shall continue to remain legally and functionally independent.

If any provision of these Terms is declared or deemed unlawful, unenforceable or void, it shall be amended in order to make it legally valid and enforceable while preserving its original intent as far as possible. If this is not possible, it shall be replaced by another valid and enforceable provision that achieves the same purpose.

These Terms shall continue to have effect for Users even after the deletion of their Account, with regard to all clauses giving rise to obligations intended to survive the termination of their effectiveness between the parties.

Any objective and/or subjective amendments to these Terms, as well as any additions to them, must be expressly agreed in writing.

mistress4you.com may unilaterally amend these Terms and/or any other terms and conditions governing the use of the Website at any time.

In particular, where the amendments are not merely descriptive, mistress4you.com will notify Users of such changes using the methods it considers appropriate, for example by pop-up, email or other suitable means.

Use of the Website after receiving such notice shall constitute full acceptance of the amendments made to these Terms.

Without prejudice to the above, any amendments made by mistress4you.com to these Terms shall become effective from the third day following their publication on the Website.

The Website may allow Users to leave reviews under the advertisements published by advertiser Users. mistress4you.com shall not, under any circumstances, be responsible for the content entered, submitted or published by Users. mistress4you.com may delete, at its sole discretion and without prior notice, User Content and/or Website Content in accordance with these Terms of Use.

The following content is prohibited on this Website:

phrases that promote racism, religious fanaticism, or violence of any kind against any group or individual;

harassment, incitement to harassment or provocation of harassment against third parties;

spam, chain letters, or unauthorised advertising;

defamatory, slanderous, insulting or offensive statements;

content that promotes unlawful activities;

violations of property rights or intellectual property rights in any field;

content that constitutes or encourages conduct that may be classified as a criminal offence, gives rise to civil liability, is otherwise contrary to the law, or infringes the rights of any other person;

creating multiple copies, whether identical or similar, of the same advertisement in order to gain more visibility;

creating multiple copies, whether identical or similar, of the same advertisement in different cities in order to gain more visibility.

We reserve the right to modify this list at any time and, using common sense, to expand it where necessary.

By publishing a review on the Website, the User grants mistress4you.com, irrevocably and without prejudice to the User’s rights under the Privacy Policy, the right to use their Content. Such Content may be read, copied, published, translated and distributed free of charge by any means and in any form, and may also be communicated to third parties for advertising and promotional activities relating to the services offered by the Website.

Users must use sensible nicknames or names both during registration in the “username” field and as their “display name”. Usernames such as “ghtfyu”, for example, are not permitted, while usernames made up of a name followed by a number or symbol are allowed.

In any case, the Website owner reserves the right to block a User or delete their Content where the User uses meaningless names, random combinations of letters, excessively vulgar names, names that cause disturbance, or names that negatively affect the meaning, tone or appearance of the Website.

We also reserve the right to delete any content present on the server or on the Website, whether during registration, advertisement creation or review submission, where the name used consists of random letters, is excessively vulgar, causes disturbance, or negatively affects the appearance or reputation of the Website.

mistress4you.com, in compliance with its legal obligations, has implemented a reporting and removal procedure for User Content or Website Content that infringes the rights of third parties.

Through the “Contact” page, you can report content to us and explain the reasons why you would like specific content to be removed, such as copyright infringement, fake advertisement, telephone number belonging to another person, or any other relevant reason.

Our staff checks reports on a daily basis and may contact you to further examine the reasons for your request.

Advertisers are solely responsible for the services offered in their own advertisements and shall be personally liable under the applicable law in the event of any violation and/or commission of any offence.

The Website Management reserves the unquestionable right to block, remove and hide advertisements and photos, and to report Users to the competent authorities where it identifies a violation of any applicable law.

In particular, the Website actively fights and opposes offences relating to child sexual abuse material, modern slavery and human trafficking for the purpose of sexual exploitation.

Human trafficking means, according to the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons, any activity relating to the recruitment, transportation, transfer, harbouring or receipt of persons by means of the threat or use of force or other forms of coercion, abduction, fraud, deception, abuse of power or of a position of vulnerability, or by giving or receiving payments or benefits to obtain the consent of a person having control over another person, for the purpose of exploitation.

Exploitation includes, at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs.

It is recalled that, under applicable UK law, such conduct may constitute criminal offences under, among others, the Modern Slavery Act 2015, including offences relating to slavery, servitude, forced or compulsory labour and human trafficking; the Sexual Offences Act 2003, including offences relating to sexual activity involving children, grooming, arranging or facilitating child sexual offences and sexual exploitation; the Protection of Children Act 1978, relating to indecent images of children; Section 160 of the Criminal Justice Act 1988, relating to possession of indecent photographs or pseudo-photographs of children; and Section 62 of the Coroners and Justice Act 2009, relating to prohibited images of children.

Therefore, where the technical management of the Website becomes aware of the commission of any of the above-mentioned offences, or receives reports from third-party Users concerning the possible commission of such offences, it hereby grants express professional authority to its legal representatives to proceed without delay in reporting any conduct that may constitute a criminal offence to the competent Police Authority or Judicial Authority.

The Website hereby states that, should the Police Authority or the Judicial Authority request information directly from the technical management of the Website, the Website will provide any useful information required for the continuation of the investigations, in order to ascertain the possible commission of the offence and to help identify the responsible party.
